1.2 Modification
Sentvia reserves the right to modify and amend this Agreement at any time, at its sole discretion. If any changes are made, the updated Agreement will be posted on the Website and Platform with the “Last Updated” date revised accordingly. We will endeavour to notify you via email sent to the address associated with your account or by in-platform notification through the Website and Mobile Application.
The use of a particular form of notice in some instances does not obligate us to use the same form in other instances. Unless otherwise stated in our notice, the amended User Agreement will be effective immediately and will apply to all current and future uses of the Services, including any pending transactions.
You are responsible for reviewing this Agreement each time you access or use the Services. 2. Compliance with Applicable Law
Your relationship with Sentvia and use of any Services are subject to the laws, regulations, and rules of governmental or regulatory authorities in both your and our jurisdiction (the “Applicable Law”). By entering into this User Agreement, you agree to comply with and be legally bound to any and all Applicable Law relevant to your use of the services and relationship with Sentvia.
3. Services
3.1. Sentvia provides technology infrastructure that facilitates cryptocurrency exchange, conversion, transaction coordination, and payment processing for supported digital assets. These services are accessible through our Platform or directly via our website and include the following:
- Cryptocurrency Exchange Services: Convert one cryptocurrency to another, or sell cryptocurrency for fiat currency, with proceeds transferred to your designated bank account.
- Cryptocurrency Transfer Services: Transfer cryptocurrency from your wallet to another designated wallet address.
- Digital Asset Infrastructure Access: Provide technical access and connectivity to third-party digital asset custody or wallet infrastructure operated by independent service providers. Sentvia does not hold, control, or safeguard digital assets or private keys on your behalf and does not act as a custodian unless expressly agreed in a separate written product agreement.
The scope of Services available to you may vary depending on your jurisdiction and the results of our onboarding and compliance review. Sentvia reserves the right to add, modify, or discontinue any Service at any time upon reasonable notice.
3.2. You authorise Sentvia to receive, transmit, process, route, and execute instructions submitted by you through the Platform, Application, Website, approved communication channels, or otherwise in writing, including by transmitting such instructions to third-party service providers, banking partners, electronic money institutions, payment providers, liquidity providers, custodians, wallet infrastructure providers, and digital asset infrastructure operators for the purpose of providing the Services.
This authorisation is limited to executing specific instructions submitted by you and does not constitute a general power of attorney or ongoing agency relationship.
Sentvia does not receive funds as principal, does not take beneficial ownership of client funds or digital assets, and does not use client funds or digital assets for its own account. Where Sentvia receives, controls, processes, or is otherwise responsible for fiat funds in connection with the Services, such funds will be handled in accordance with Applicable Law, Sentvia’s safeguarding framework, and any applicable third-party provider arrangements.
This authorisation may be revoked by you at any time upon written notice, subject to completion, cancellation, reversal, return, or settlement of any pending transaction, compliance review, regulatory reporting obligation, outstanding fee, charge, reversal, or other obligation owed to Sentvia or its third-party providers.
3.3 You acknowledge and agree that the Services made available to you may be limited based on the Jurisdiction from which you are accessing the Services from. Sentvia reserves the right to restrict or terminate your access to the Services made available to you based on your location. You further acknowledge and agree that the Services may be limited or terminated if you are located in or move to a jurisdiction that is not supported by Sentvia. Sentvia shall not be liable for any claims, damages or limitations relating to the access of the Services based on your location on termination of Service resulting from your access of the Service from an unsupported jurisdiction. You agree to indemnify and hold Sentvia harmless from any consequences resulting from your use of the Services in violation of geographic restrictions.
3.4 OTC services involve direct, custom trade execution and settlement coordinated by Sentvia. Pricing and execution are not guaranteed until expressly confirmed by both parties in writing. In periods of extreme market volatility, severe liquidity disruption, or systemic market dislocation as determined by Sentvia acting reasonably and in good faith Sentvia may cancel or decline execution of an accepted RFQ where execution is commercially impracticable or inconsistent with Sentvia’s risk management framework. In such cases, Sentvia shall notify you as soon as reasonably practicable and, where funds have already been received, shall return them to the originating account or wallet within a reasonable time, subject to applicable compliance checks. Sentvia shall not be liable for market movements or losses arising from such cancellation, provided it acted reasonably.
All OTC communications shall be recorded, retained, and auditable in accordance with Sentvia’s record-keeping obligations under Applicable Law. Settlement terms, compliance requirements, and any bespoke pricing arrangements applicable to OTC transactions shall be communicated by Sentvia in writing prior to trade execution and shall form part of this Agreement in respect of that transaction. Upon the establishment of an account, you shall designate a preferred communication channel for OTC services. Sentvia’s default channel is Telegram, although alternative channels including Slack, WhatsApp, or email may be arranged upon request, subject to Sentvia’s operational capacity.
To initiate an OTC transaction, you must notify Sentvia of:
- the incoming payment details, including currency and amount;
- the desired output currency; and
- the designated destination for the converted funds.
Upon receipt of funds, Sentvia will issue a Request for Quote (RFQ) through the agreed communication channel. Once you expressly accept the RFQ, the conversion rate becomes fixed and the transaction will be executed accordingly.
For cryptocurrency disbursements, Sentvia will by default initiate a test transaction to the wallet address you provide. The remaining balance will be disbursed upon confirmation of receipt. You may choose to waive the test transaction and instruct Sentvia to transmit the full amount directly, in which case you accept all associated risks. Sentvia shall not be liable for any loss, misdirection, or unrecoverable funds due to wallet address errors, regardless of whether a test transaction was waived, except to the extent that such loss is directly and demonstrably caused by a verified failure of Sentvia’s own systems or Sentvia’s gross negligence.
3.5 The Services may depend on third-party service providers, including banking partners, electronic money institutions, payment service providers, liquidity providers, custodians, wallet infrastructure providers, blockchain networks, compliance screening providers, transaction monitoring providers, identity verification providers, and other regulated or unregulated service providers. Sentvia does not control and is not responsible for the acts, omissions, availability, solvency, safeguarding arrangements, regulatory status, transaction processing, delays, errors, restrictions, freezes, refusals, reversals, outages, or operational failures of any third-party service provider.
3.5.1 To the fullest extent permitted by Applicable Law, Sentvia shall not be liable for any loss, delay, error, claim, damage, liability, failed transaction, rejected transaction, suspended transaction, restricted account access, or inability to access funds or digital assets arising from or in connection with any Third-Party Service, except to the extent directly caused by Sentvia’s own fraud, wilful misconduct, or gross negligence in the selection or supervision of such provider. You acknowledge that third-party providers may impose additional onboarding, compliance, transaction monitoring, sanctions screening, documentation, reporting, safeguarding, operational, jurisdictional, or risk management requirements. You agree to cooperate with such requirements. Sentvia may delay, reject, suspend, restrict, or terminate access to any Service where required by a third-party provider or where Sentvia reasonably considers such action necessary to protect its legal, regulatory, banking, operational, or reputational position.
3.6 Where fiat funds received, processed, held, or controlled in connection with the Services qualify as end-user funds under Applicable Law or Sentvia’s safeguarding framework, Sentvia will treat such funds as separate from Sentvia’s own corporate funds and will safeguard them in accordance with Applicable Law, Sentvia’s safeguarding framework, and any applicable third-party provider arrangements. End-user funds may be held in a trust, safeguarding, segregated, client money, or equivalent account maintained by Sentvia or by a regulated banking partner, electronic money institution, payment provider, custodian, or financial institution under that provider’s own legal and regulatory framework. Funds subject to compliance review, transaction monitoring, AML/CTF review, sanctions screening, fraud investigation, law enforcement request, regulatory restriction, banking partner review, operational delay, or settlement delay may be held, delayed, suspended, restricted, returned, rejected, or otherwise dealt with by Sentvia in accordance with Applicable Law and Sentvia’s internal policies. Where such funds qualify as end-user funds, Sentvia will continue to treat them as safeguarded funds until they are released, returned, transferred, settled, or otherwise dealt with in accordance with Applicable Law.
3.7 Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under Applicable Law, including liability for fraud or fraudulent misrepresentation. For the avoidance of doubt, and without limiting the foregoing, liability for gross negligence and wilful misconduct may be limited or capped in accordance with Clause 11.7 to the extent permitted by Applicable Law.
3.8 Except where expressly stated in this Agreement, required by Applicable Law, or agreed in a separate written product agreement, Sentvia does not act as a bank, deposit-taking institution, custodian, trustee, fiduciary, escrow agent, investment adviser, broker, portfolio manager, or discretionary manager in respect of any fiat funds, digital assets, transactions, or client instructions. Any safeguarding, trust, segregated account, client money, or equivalent arrangement maintained in respect of end-user funds is established solely for the purpose of protecting such funds in accordance with Applicable Law, Sentvia’s safeguarding framework, or third-party provider arrangements. Such arrangements do not create any broader fiduciary, advisory, investment management, custody, deposit-taking, or escrow relationship between Sentvia and you.
4. Accessing the Services
4.1 Limited License
Sentvia grants you a limited, non-exclusive, non-transferable right to access and use the Services and the Website solely in accordance with the terms and conditions of this User Agreement.

You are solely responsible for managing and maintaining the security of your credentials, including but not limited to usernames, passwords, and API keys. If you suspect any unauthorised access or security breach, you must notify Sentvia immediately to minimise potential risks.
4.3 Compliance
Your access to one or more Services is conditional upon creating a Sentvia Account and satisfying Sentvia’s onboarding, due diligence, enhanced due diligence, transaction monitoring, sanctions screening, fraud prevention, source of funds, source of wealth, and other compliance requirements. Sentvia may request information and documents from you at onboarding and on an ongoing basis, including information concerning your identity, ownership, control structure, directors, officers, authorised users, business activity, financial position, source of funds, source of wealth, transaction purpose, counterparties, senders, recipients, invoices, contracts, bank statements, wallet addresses, beneficiaries, and any other information Sentvia considers necessary for compliance, risk management, or third-party provider requirements.

Sentvia will process information requests in a reasonable and proportionate manner consistent with applicable law. Where Sentvia requires additional information, it will specify clearly what is required and the purpose of the request. If you believe a request is unclear or disproportionate, you may raise this with us in writing at compliance@sentvia.com, and we will respond within a reasonable timeframe. Failure to provide requested information without valid justification may result in temporary restriction or permanent suspension of your access to the Services.
4.4 Communications
Any and all communications from Sentvia, including notices related to this User Agreement or your use of the Services, will be sent via electronic mail at the address provided when accessing the Services. Sentvia is not liable for any loss or damage resulting from your failure to receive a communication, provided it was sent to your registered email address.

Notwithstanding the above, Sentvia may suspend or disable your access with immediate effect and without prior notice where:
- you are in material breach of this Agreement;
- you have failed to provide accurate, complete, or up-to-date information as required under this Agreement;
- Sentvia is required to do so by applicable law, regulation, or a regulatory or governmental authority;
- there is a reasonable suspicion of fraud, money laundering, terrorist financing, or other criminal activity involving your account;
- continued provision of Services would expose Sentvia, its banking partners, or its regulatory relationships to material legal, regulatory, or reputational risk;
- a transaction is inconsistent with your risk profile, business activity, expected transaction behaviour, onboarding information, or supporting documents;
- a third-party provider restricts, suspends, refuses, recalls, reverses, or delays a transaction or Service; or
- Sentvia considers such action necessary to protect the integrity, security, or availability of the Services.
Where Sentvia exercises its right to immediate suspension under paragraphs (a) to (h) above, Sentvia shall provide written reasons within five (5) business days, to the extent permitted by applicable law, including obligations arising under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) or equivalent legislation in any applicable jurisdiction.

From time to time, Sentvia may require you to change your Login Credentials and re-verify your Background Information at our sole discretion and as a condition to your continued access to and use of your Sentvia Account and the Services. You hereby represent and warrant that you will not share your Login Credentials with any third-party or permit any third-party to gain access to your Sentvia Account; and you hereby assume responsibility, to the extent permitted by Applicable Law, for any instructions, Orders, or actions provided or taken by anyone who has accessed your Sentvia Account regardless of whether the access was authorised or unauthorised.
5.2 Account Eligibility
By opening an Account you represent and warrant that doing so (i) does not violate the laws or regulations of your place of incorporation, principal place of business, or residence, and (ii) does not place Sentvia in breach of any trade-sanctions regime. By opening an account, you confirm that doing so does not violate any applicable laws or regulations. You agree to indemnify and hold us harmless against any direct losses, including legal costs and penalties, incurred as a result of your failure to meet this condition.
5.3 Application Approval and Restrictions

5.4 Accuracy of Information
You must ensure that all information provided to Sentvia during registration and throughout the term of your use, must be accurate, complete and truthful. Should any changes occur in your information, you must update us within fourteen (14) calendar days from the date of change. We will maintain these records in compliance with applicable laws and regulations.

You agree to update your Sentvia Account promptly upon any changes to the Background Information you previously provided. Please note that a change in your state or country of residence may affect your eligibility to access and use the Services. You agree to notify Sentvia as soon as possible of any such change in residence. As part of our legal compliance and anti money laundering program (the “AML Program”), Sentvia may monitor your account activity and review your Background Information and transactions on an ongoing basis, as required by applicable laws and our internal policies. We may, at any time, request additional Background Information or other relevant details as a condition for your continued access to the Services. During this review period, your access to the Services may be temporarily restricted. Access will be restored promptly once the requested information is reviewed and approved.

Restrictions may apply to transactions involving unsupported jurisdictions, restricted countries, sanctioned persons, high-risk industries, prohibited goods or services, unsupported digital assets, unsupported wallets, unusual transaction behaviour, incomplete documentation, inconsistent invoices, unexplained source of funds, third-party payments, or activity inconsistent with your onboarding profile.
Sentvia may be unable to provide prior notice or a detailed explanation where prohibited by law, where disclosure may constitute tipping off, or where disclosure may compromise compliance controls, investigations, or third-party provider obligations.
5.7 Prohibition of Unauthorised Access
You may not permit unauthorised third parties to use the account and/or services without our explicit written consent. Non-compliance may result in account closure, and you may be held liable for any financial losses incurred if unauthorised access was granted.
5.8 Account Access by Unauthorised Individuals
If you share account access with someone you authorise, you are responsible for any actions, misuse, or disclosure of account information by that individual.
5.9 Digital Asset Wallet Infrastructure
Where wallet functionality is made available through the Platform, such functionality is provided through third-party digital asset infrastructure, wallet, or custody providers. Sentvia does not hold, control, safeguard, or custody digital assets or private keys on your behalf. Any reference to a “wallet” in this Agreement refers to technical access to third-party wallet infrastructure or digital asset functionality made available through the Platform. It does not mean that Sentvia acts as custodian, trustee, fiduciary, deposit-taking institution, wallet provider, or escrow agent in respect of digital assets. You are responsible for ensuring that any wallet address, network, token, blockchain, memo, tag, or other transfer information you provide is accurate, complete, supported, and compatible with the relevant digital asset and network. Sentvia shall not be liable for any loss, delay, misdirection, failed transfer, unsupported asset transfer, or unrecoverable digital assets resulting from incorrect or unsupported wallet information, except to the extent directly caused by Sentvia’s own fraud, wilful misconduct, or gross negligence.
6. Account Security and Credentials

This includes, but is not limited to, your login credentials (username and password), API keys, and any other forms of authentication or access control. You understand and acknowledge that, to the extent permitted by Applicable Law, we are not responsible (and you will not hold us responsible) for any unauthorised access to and or use of your Login Credentials and/or Sentvia Account (“Unauthorised Access”). You understand and agree that you are solely responsible for maintaining the security of your Login Credentials by periodically updating your Login Credentials and by keeping your Login Credentials and other forms of authentication confidential and separate from each other. 6.5 Reporting Security Breaches
If you suspect that your account or credentials have been compromised or notice unauthorised access or any security breach, you must notify us immediately by emailing info@sentvia.com. While we will assist you in resolving the issue, we are not liable for any losses incurred as a result of such breaches, even if caused by unauthorised use of your account or credentials, with or without your knowledge.

You acknowledge and agree that we are not liable for any losses, damages, or unauthorised access resulting from:
- Your failure to secure your account credentials.
- Exploitation of your operational security by malicious actors.
6.7 Indemnification for Security Failures
By using our services, you accept full responsibility for protecting your account and credentials. You also agree to indemnify and hold us harmless from any claims, damages, or losses arising from your failure to maintain security or from unauthorised access to or misuse of your account.
7. Cryptocurrency Processing Services
7.1 Platform for Cryptocurrency Transactions
Sentvia provides a secure processing platform, accessible through your website or platform interface, to facilitate consumer transactions in cryptocurrency.
7.2 Definition of Consumers and Transactions
A consumer means an end-user, payer, sender, customer, or other person who uses or participates in a transaction connected to goods or services provided by you or your associates. A transaction means the processing, routing, conversion, transfer, settlement, or coordination of funds or digital assets through the Services, the Platform, applicable third-party providers, or applicable blockchain networks in accordance with your instructions and this Agreement. References to Sentvia processing, receiving, collecting, forwarding, transferring, or settling funds describe Sentvia’s operational role in coordinating transaction flows and do not mean that Sentvia receives funds as principal, takes beneficial ownership of funds, or acts as a bank, deposit-taking institution, custodian, trustee, fiduciary, or escrow agent.
7.3 Settlement of Payments
Sentvia acts as payment facilitator and transaction coordinator in connection with the collection and settlement of payments. Sentvia does not receive funds as principal, does not take beneficial ownership of client funds, and does not fund settlements from its own balance sheet.
Where funds are handled in connection with the Services, they are either:
- held by Sentvia in designated trust or safeguarded arrangements for the benefit of clients during the period between receipt and onward transfer to the relevant banking partner; or
- held by the relevant regulated banking partner, electronic money institution, payment provider, custodian, or wallet provider under that provider’s own legal and regulatory framework.
Such funds may be held in a designated trust, safeguarding, segregated, client money, or equivalent account, or may be held by a regulated banking partner, electronic money institution, payment provider, custodian, or other financial institution under that provider’s own legal and regulatory framework.
References in this Agreement to Sentvia collecting payments or settling transactions describe Sentvia’s operational role in coordinating payment flows, routing instructions, and arranging settlement through the applicable safeguarded structure or regulated third-party provider. They do not mean that Sentvia receives funds as principal or takes beneficial ownership.
7.4 Compliance Holds
Sentvia may place funds, digital assets, transactions, accounts, wallets, payment instructions, conversion instructions, settlement instructions, or withdrawals on hold where required or considered necessary for AML/CTF, sanctions, fraud prevention, transaction monitoring, travel rule compliance, regulatory reporting, law enforcement requests, banking partner requirements, third-party provider requirements, operational risk, cybersecurity, or Applicable Law.
During any such hold, Sentvia may be restricted from disclosing the reason for the hold or the expected duration of the hold. Sentvia shall not be liable for any loss, delay, market movement, opportunity cost, business interruption, or consequential loss arising from a compliance hold, except to the extent directly caused by Sentvia’s own fraud, wilful misconduct, or gross negligence.
Where funds subject to a compliance hold qualify as end-user funds under Sentvia’s safeguarding framework, Sentvia will continue to treat them as safeguarded funds until they are released, returned, transferred, settled, or otherwise dealt with in accordance with Applicable Law.
8. Cryptocurrency Exchange Services
8.1 Overview of Service
Sentvia provides services within the scope of its FINTRAC MSB registration and applicable third-party provider arrangements, including virtual currency exchange, virtual currency transfer, fiat-to-virtual currency conversion coordination, virtual currency-to-fiat conversion coordination, and related transaction coordination services.
Where regulated payment services, electronic money services, safeguarded account services, named account services, virtual IBANs, custody services, or wallet infrastructure are made available through the Platform, such services may be provided by the relevant regulated third-party provider and not by Sentvia, unless Sentvia is separately authorised, registered, or permitted to provide such services in the relevant jurisdiction.
By using the cryptocurrency exchange services, you acknowledge the risks, limitations, execution conditions, compliance requirements, settlement requirements, and third-party dependencies set out in this Agreement.
8.1.1 Quote Request and Time Limit
When you request a quote for a trade there is a specific time limit for accepting the quote:
- You must accept the quote within this time frame to proceed with the trade.
- If the quote is not accepted before the time limit expires, the exchange rate will refresh, and a new quote must be requested. Accepting a quote within the time limit is required to initiate a trade.
8.1.2 Non-Guarantee of Trade Execution
Accepting a quote does not guarantee trade execution.
- Various factors, such as technical issues, market volatility, or compliance requirements, may prevent a trade from being executed even after a quote has been accepted.
8.1.3 Trade Submission and Settlement
A trade is only deemed successfully submitted once your account balances have been adjusted to reflect the trade. Until the trade is settled and the balances are updated, the trade is not considered valid.
8.1.4 Limitation of Liability
You acknowledge and accept the inherent risks of trading cryptocurrencies and fiat currencies. We are not liable for losses or damages arising from:
- Inability to accept a quote within the time limit.
- Non-execution of a trade after accepting a quote.
- Delays in trade settlement.
8.1.5 Acceptance of Risks and Indemnity
By using our cryptocurrency exchange service, you accept all trading obligations and risks outlined in this policy.
- You are responsible for accepting quotes promptly and acknowledge that trading risks are solely yours.
- You agree to indemnify and hold us harmless from any claims, damages, or losses resulting from your trading activities.
9. Fee for Services

9.1.3 Fee Details: The specific fees for each Service is provided in the Table for Services and Fees below.
9.2 Currency Conversion
You understand that if the transaction currency differs from your sub-wallet’s settlement currency, we will apply a currency exchange rate to convert the transaction amount accordingly.
9.3 Consumer Verification Responsibility
You understand that we do not guarantee the identity of your Senders or ensure that a Sender will complete a transaction. It is solely your responsibility to verify your Senders’ identities and comply with local regulations related to Customer Identification and Anti-Money Laundering laws.
9.4 Transaction Processing and Liability
9.4.1 Our Role: You understand and agree that Sentvia’s role is to facilitate, coordinate, route, process, convert, or arrange transactions in accordance with your instructions, this Agreement, Applicable Law, and the requirements of applicable third-party providers. Where funds are received, held, processed, or settled in connection with the Services, they may be handled by Sentvia or by third-party providers in accordance with the safeguarding, trust, segregated account, client money, or equivalent arrangements applicable to the relevant Service.
9.4.2 Limitation of Liability: You understand and agree that the extent of our involvement in the transaction process is limited to 9.4.1 above, and we are not liable for any disputes between the Sender and the Recipient regarding the goods or services provided.
9.5 Network Fees
9.5.1 Right to Charge Fees: You understand and agree that we reserve the right to impose network fees (miner fees) for processing cryptocurrency transfers on your behalf.
9.5.2 Fee Determination and Notification: You understand and agree that the network fee will be determined at our discretion, and we will inform you of the fee at or before the time you authorise the cryptocurrency transfer.
9.5.3 Transaction Confirmation: You understand and agree that after submission to the cryptocurrency network, transfers remain unconfirmed for a period until sufficient confirmations are received. Pending transactions will not be credited to your wallet until they are confirmed.
9.6 Withdrawal Rights and Restrictions
9.6.1 Withdrawal Rights: You may initiate a withdrawal of funds to the bank account registered with us at any time.
9.6.2 Account Restrictions: Withdrawals can only be made to the registered bank account and cannot be directed to any other account.
9.7 Withdrawal Fees
You understand and agree that Sentvia will charge your account and deduct from your account service fees for any withdrawal of funds to your bank account as per the fee specified for the specific service in the Table of Services and Fees.
9.8 Bank Exchange Rates and Additional Fees
You understand and agree that we are not responsible for any exchange rates or additional fees your bank may charge for currency conversion or other services.
9.9 Fee Estimates and Challenges
We aim to provide accurate estimates of network fees required to send transactions on various blockchain networks at all times. These estimates are based on current network conditions and our assessment of fees that are likely to ensure timely transaction confirmation.
You understand and agree that, in spite of our best efforts, due to the unpredictable nature of blockchain networks, estimating precise fees remains inherently challenging.
9.10 Impact of Blockchain Conditions
Sentvia uses commercially reasonable efforts to provide the Services in a reliable and secure manner. From time to time, interruptions, delays, or other deficiencies in providing the Services may occur due to a variety of factors, some of which are outside Sentvia’s control and some which may require or result in scheduled maintenance or unscheduled downtime of the Services (collectively, “Downtime”). You understand and acknowledge that blockchain technology makes it difficult to predict exact network fees for transactions at any given time, and that part or all of the Services may be unavailable during any such period of Downtime. Following Downtime, you further understand and acknowledge that the prevailing market prices for cryptocurrency and our Fee estimates may differ significantly from the prices prior to such Downtime.
9.11 Estimated vs. Actual Fees
You understand and agree that the network fee we provide as an estimate may not match the actual fee reflected in your transaction hash once the transaction is broadcast to the blockchain network. The actual fee may be higher or lower than our estimate due to real-time network conditions at the time of transaction processing.
9.12 Liability for Discrepancies
You understand and agree that we are not liable for any discrepancies between the estimated network fees we provide and the actual fees incurred for your transactions; and that we are not responsible for additional costs, losses, or delays arising from such discrepancies.
9.13 Acceptance of Risks
Please note that all transactions involving digital assets and cryptocurrency involve substantial risks. You should therefore carefully consider whether using our Services is suitable for you in light of your financial condition. In considering whether to hold digital assets, you should be aware that the price or value of a digital asset can change rapidly, decrease, and potentially even fall to zero. Past performance is not an indicator of future performance. You acknowledge that we are not responsible for any loss of your digital asset, resulting from theft, loss, or mishandling of private keys outside our control.
We are not responsible for any digital asset and we make no representations or warranties concerning the real or perceived value of digital assets as denominated in any quoted currency. Although we may provide historical and/or real-time data regarding the price of digital assets, we make no representations regarding the quality, suitability, truth, usefulness, accuracy, or completeness of such data, and you should not rely on such data for any reason whatsoever. You understand and agree that the value of digital assets can be volatile, and we are not in any way responsible or liable for any losses you may incur by using or transferring digital assets in connection with our Services.
We do not provide investment advice and any content contained on the Website and Platform should not be considered as a substitute for tailored investment advice. The contents of our Website and the Services should not be used as a basis for making investment decisions.
By using our services, you acknowledge and accept the inherent challenges of providing accurate network fee estimates. You understand and agree to bear the risks associated with differences between estimated and actual transaction fees.

The exclusions and cap in this clause shall not apply to liability arising from:
- fraud or fraudulent misrepresentation;
- wilful misconduct;
- gross negligence;
- breach of clause 15 (Confidentiality); or
- breach of applicable data protection law by Sentvia, or Sentvia’s material breach of its obligations under this Agreement relating to the processing, protection, or unlawful disclosure of personal data.
